Terms of Service

HostDango.com

Effective January 1, 2026

HostDango.com ("the Company") agrees to furnish services to the Subscriber subject to the following Terms of Service ("TOS"). Use of HostDango.com hosting services constitutes acceptance of both this TOS and our Acceptable Use Policy (AUP). This Agreement shall be construed in accordance with the laws of the State of Alaska.

1 Disclosure to Law Enforcement

The AUP specifically prohibits the use of our service for illegal activities. Subscriber agrees that the Company may disclose any and all subscriber information — including assigned IP numbers, account history, and account use — to any law enforcement agent who makes a written request, without further consent or notification to the Subscriber. HostDango also reserves the right to terminate all service under this Agreement in such circumstances.

2 Service Rates

Subscriber acknowledges that the nature of the service and the initial rates and charges have been communicated. Subscriber is aware that the Company may prospectively change specified rates and charges from time to time.

3 Payment

Establishment of service is dependent upon receipt of payment of stated charges. Subsequent payments are due on the anniversary date of the month for that month's service.

4 Payments and Fees

Credit cards that are declined for any reason are subject to a $1.00 declination fee and will be processed on a daily basis. Accounts that become past due will be suspended immediately. Service interrupted for nonpayment is subject to a $10.00 reconnect charge. Accounts not paid by the due date are subject to a $7.95 late fee.

Accounts that are not collectable may be turned over to an outside collection agency. If your account is turned over for collection, you agree to pay a Processing and Collection Fee of not less than $50 nor more than $150.

5 Refunds and Disputes

All payments to HostDango are nonrefundable. This includes setup fees and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 60 days of the date the dispute occurred.

If you dispute a charge to your credit card issuer that HostDango determines, in its sole discretion, to be a valid charge under this TOS and/or AUP, you agree to pay HostDango an Administrative Fee of not less than $50 and not more than $150.

6 Failure to Pay

The Company may temporarily deny service or terminate this Agreement upon failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for payment of all accrued charges, plus reasonable interest and any collection fees.

7 Account Cancellation

The required method of cancellation is via the Support Desk. You must log into the Client Center and submit a formal cancellation request in order for an account to be cancelled. Cancellations cannot be processed by any other method.

8 Interruption of Service

Subscriber acknowledges that service can be interrupted for many reasons other than the negligence of the Company, and that damages resulting from any interruption of service are difficult to ascertain. The Company shall not be liable for any damages arising from causes beyond its direct and exclusive control. The Company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by Subscriber for services during the period damages occurred. In no event shall the Company be liable for any special or consequential damages, loss, or injury.

9 Support Boundaries

HostDango provides 24/7 technical support to subscribers. We limit our support to our area of expertise — specifically issues related to the physical functioning of your service or virtual site.

HostDango does not offer technical support for application-specific issues such as CGI programming, HTML, or other third-party software unless it is in direct relation to a product purchased from HostDango. Support for applications or software uploaded or installed by you must go through the application or software vendor.

10 SPAM and Unsolicited Commercial Email

HostDango takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Customers may not use or permit others to use our network to send UCE. Customers may not host, or permit hosting of, sites or information advertised by UCE from other networks.

A. Upon notification of an alleged violation, HostDango will initiate an immediate investigation within 48 hours. During the investigation, HostDango may restrict customer access to prevent further violations. If a customer is found in violation, HostDango may restrict, suspend, or terminate the account. HostDango reserves the right to pursue civil remedies and will notify law enforcement if the violation is believed to be criminal.

B. First violations will result in an Administrative Fee of $250 and account review for possible immediate termination. A second violation will result in an Administrative Fee of $500 and immediate termination. Users also agree to pay Research Fees not to exceed $175 per hour for HostDango personnel time spent investigating the matter.

Important: Anyone hosting websites or services that support spammers or cause HostDango IP space to be listed in spam databases will have their server immediately removed from the network without notice. Severe or repeat violations will result in permanent removal.

11 Network

IP Address Ownership: Any Internet Protocol address assigned to a customer belongs solely to HostDango. Customers have no right to use that IP address except as permitted by HostDango in connection with the Services during the term of this Agreement. HostDango reserves the right to change or remove any assigned IP addresses at its sole discretion. Customers must use name-based hosting where possible.

Bandwidth and Disk Usage: Customer agrees that bandwidth and disk usage shall not exceed the amount specified for the services ordered. In the event of over-usage of bandwidth, customers will be assessed a fee of $0.50 per GB. HostDango may take corrective action — including assessment of additional charges, disconnection, or termination — if usage exceeds agreed limits.

System and Network Security: Users are prohibited from violating or attempting to violate the security of the HostDango network. Violations include:

12 Notification of Violation

A. HostDango is under no duty to monitor customer activities to determine if a violation of the AUP has occurred.

B. First violation: The user will receive a warning email. Service may be temporarily suspended pending a written agreement to refrain from further violations.

C. Second violation: Service will be subject to immediate suspension or termination without further notice.

D. HostDango reserves the right to drop IP space involved in spam or denial-of-service complaints if the activity is causing significant harm, including in rare cases before contacting the customer. Contact will be made as soon as feasible.

13 Suspension or Cancellation

HostDango reserves the right to suspend network access to any customer if, in the judgment of HostDango network administrators, the customer's service is the source or target of a violation of the AUP or any other terms. If inappropriate activity is detected, all accounts of the customer in question may be deactivated pending investigation. Prior notification is not guaranteed. The customer will not be credited for any time services were suspended.

14 Policy Amendments

HostDango reserves the right to amend its policies at any time. All customers must adhere to current policies. Failure to follow any term or condition will be grounds for immediate cancellation.

15 Indemnification

By agreeing to this TOS and AUP, customer indemnifies HostDango for any violation of the AUP or TOS that results in loss to HostDango or the bringing of any claim against HostDango by any third party. This means that if HostDango is sued because of a customer's activity, the customer will pay any damages awarded against HostDango, plus all costs and attorney's fees.

16 Miscellaneous Provisions

You must provide HostDango with — and keep current — good contact information including email, and phone. Email is the preferred contact method.

A. A waiver by the Company of any breach of any provision of this Agreement shall not operate as a continuing or subsequent waiver thereof.

B. Subscriber shall not transfer or assign this Agreement without the prior written consent of the Company. The Company may assign this Agreement at any time without consent from or notice to Subscriber.

C. HostDango takes no responsibility for any material input by others. HostDango is not responsible for the content of any websites linked to the HostDango network. HostDango disclaims any responsibility for any inappropriate use by third parties.

D. HostDango is not responsible for any damages your business may suffer. HostDango does not make implied or written warranties for any of our services, including loss of data resulting from delays, non-deliveries, wrong delivery, or service interruptions.

E. It is absolutely forbidden to host pornographic content or IRC servers on Virtual Server accounts. Accounts found hosting this material will be subject to immediate cancellation without refund.

17 Responsibility for Content

You, as a HostDango customer, are solely responsible for the content stored on and served by your servers. Any applications installed or uploaded by you are your responsibility. HostDango cannot and will not support third-party applications installed by customers — support for such software must go through the application or software vendor.

18 Abuse Towards Staff

Abuse towards HostDango staff or network staff will not be tolerated. Use of foul language, threats, or any behavior our staff finds offensive may result in account suspension or termination without refund, per our AUP and TOS.
